Sub :Re-allotment/Transfer of existing fiats in favour of legal beirs/dependents
of deceased allottees of Behala Colony.

Sir,
i am directed to refer letter no. BTMS/1/91-92/23 dt. 31.8.92 on the above subject and to say that the following measures may be adopted for re-allotment of flats of deceased allottees of Behala Colony.
1. Where the ballottee-tenant is dead leaving dehind his wife, sons and daughters re-allotment may be made in favour of the windows if she is alive (preovided she has mot remarried in which case the children by the first marriage should have equal rights). As bettween various family mambers, the ones who are actually residing there should be given priority. Joint deed may be give to family mambers residing these if the wifw ot the allottee tenant also is dead.
2. Where the original allottee-tenant is dead and he/she had no surviving family (wife, son(s), daughterls) any one of his legal heir may be offered the flat on transfer; re-allotment, with the consent of all other legal heirs.
