(vIII) Role of Colony Committee:
A colony Committee should be a democratically elected body with representative of the inhabitants of the d. p. colony, duly recognised by R. R. & R. Department. Its main function is to assist the Government in R. R. & R. Department, to implement the government policy matters. The committee will work as a consultative body/in advisory capacity without any statutory powers followed by an Executive order No. 160(143)/ RC (DEV), 1.3.89. (ANNEX-102)
D. MONITORING OF R. R. WORKS AT SUB-DIVISION/DISTRICT/STATE LEVEL:
The policies and guidelines which are to be followed in the matter of regularisation of refugee colonies need speedy implementation. Hence for the purpose of periodical review and monitoring the progress of work, District Magistrates were instructed for setting up an Implementation Committee at the district level as well as at the Sub-divisional level vide D.O. No. 65 (16)-Rehab/7L-10/83 (supp. Vole I); dt. 18.6.87 (ANNEX-103).
Of late, instructions were sent to the districts regarding preliminary survey of 998-group. In this regard, separate D. O., 13-28 Rehab/18R-5/97 dt. 26.5.97 regarding formation of DIC/SDIC has been sent to all District Magistrates (ANNEX-104).
State level monitoring committee under the Chairmanship of the Chief Secretary, Govt. of West Bengal was constituted for the purpose of monitoring the progress in respect of land acquisition cases, inter-departmental land transfer cases and distribution of free-hold title deeds. The Committee included the Member, Board of Revenue, Secretary, Finance Department, Secretary, R. R. & R. Department and an Officer from Ministry of Home Affairs, Rehabilitation Division, and Govt. of India (ANNEX-105).
2. Baynanama scheme and deed of reconveyance
1. Baynanama Scheme refers to plots purchased by the refugees on his own initiative from the Rayats/land owners, first making an agreement/Bayna-patra. Subsequently, on payment of land value within the prescribed ceiling to the refugees as loan, individual deeds are registered in respective registry offices along with a loan bond. All these instruments are hypothecated to the government in R. R. & R. Department.
2. In reference to the recommendation of the 8th Finance Commission, 1984, the Government of India, Ministry of Home Affairs, had written off a total sum of Rs. 35, 49, 53,000/- (thirty five crores forty nine lakhs fifty three thousand) being the outstanding balance of loans sanctioned to the refugee persons. The State Government had written off the same amount vide memo. No. 151(16) B & A dt. 1.10.86 and 2163(67) B & A; dt. 29.5.86. Further, recovery of interest and penal interest outstanding on the loans written off was also waived off (ANNEX-83 and 84)
3. Deputy Secretary, R. R. & R. Department, R. R. Directorate Officers not below the rank of Deputy Directors, District Magistrates including Additional District Magistrates, SDOs and all Executive Deputy Magistrates were empowered to sign on behalf of the Governor, all the instruments for the purpose of registration of reconveyance deed. 4. Executive Order No. 1525-F.T. dt. 6.5.87 (ANNEX-87) elucidates that stamp duty has been remitted during execution of deed of reconveyance.
