Sub : Release of mortgaged property and return of title deed and all
documents relating to the mortgaged property to the Mortgagor/his
heirs/Successors.

Consequent on the remission of all types of loans advanced to the dps. for their rehabilitation and interest accrued thereon it has become obligatory on the part of the Government to release a large number of mortgaged propeties with the title deeds and other related documents in favour of the Mortgagors or their heirs/Successors. Because of the enormous magnitude of the task involved in this work, It was. being examined in this Department for sometime past if a simple procedure could be evolved in the matter of releasing the mortgaged properties instead of following the formal procedure of reconveyance by registratior.
2. in continuation of this Department Memo. No.419J(17)-Rehab dated 11.9.87 on the subject indicated above, the undersigned is directed to say that after a careful and circumspective consideration it has now been decided that in the cases where the Mortgagors or their heirs/Successors will feel satisfied with to return of the mortgage deeds only with an endorsement thereon to the effect that the loans advanced to the Mortgagor and interest accrued thereon have been fully remitted and that the mortgaged property has been released from mortgage, it is not necessary to execute formal reconveyance by registration in such cases. In other cases, norma: procedural formalities will be observed as per existing policy of registration of reconveyance deed.
3. Each and every Mortgagor should be made aware of this option very dead•, so as to enable him to exercise his option on his own will and pleasure and without any compulsion and that choice once made cannot be reversed.
