(thirty) years on condition that the lease is liable to cancellation in case the land is not utilised for the purpose for which it was leased out. This modifies this Department's Order No.4742-Rehab/5L-30/80 dated 3.8.81.

h. Markets :
  1. Land on lease may be given of the same terms and conditions as mentioned in para (g) above to Municipalities and Local Bodies for setting up markets in areas of refugee concentration. Alternatively,
  2. If the Department considers it desirable, or, if the market is not being set up with the specific object or refugee rehabilitation and the Department is in a position to spare the land, the land may be transferred to the Land and Land Reforms Department for necessary action.
  3. Existing markets may be transferred to Lacal Bodies on the same terms as in (i) above for effective management In other areas, the land may be transferred to the Land and Land Reforms Deptt. for further action.
  4. In case, the land is retained by the RR & R Department individual plots/stalls in the market may be given on lease by the RR & R Department under the following terms and conditions.
    1. The applicant should be a bonafide displaced person or his/her heir
    2. He/She should preferably be a resident of the refugee colony in which the shop is located and
    3. He/She will not utilise it for any other purpose save and except that for which it is given, failing which the lease will be liable of cancellation.This modifies this Department's Order No.4742-Rehab/5L-30/80 dated 3.8.81, No.3173 (8) Rehab/5L-31 87 dated 17.8.87, No. 6446-Rehab/ 10M-99/80 dated 21.11.81 and No. 4032-Rehab dated 19.9.89.
i.Tank Fisheries :
Tank Fisheries may be leased out in accordance with the provisions of this Department Order No. 2490(17)-Rehab/6L-77/76 dated 10.7.87 subject to the condition that the lease rent for the Fishery will be fixed in accordance with the procedure laid down in the West Bengal Land and Land Reforms manual. This modifies this Department's Order No. 2490(17)-Rehab dated 10.7.87.

2. Homestead Lands :
With regard to the homestead land in the squatters' colonies it is an approved policy to grant free-hold title deed for the lands squatted upon upto an area of 5 (five) Kathas in both rural and urban areas and the land areas excess of 5 (five) Kathas of homestead land in possession of the Displaced Person Squatter Families should be treated as surplus and such displaced persons families should either be surrendered in favour of the RR & R Department or, the possessor family should pay the price for the surplus portion of the plot at the market rate.
(ii) In the rural Government Sponsored Colonies, according to the prevailing practice, upto 10 (ten) Kathas of land are granted earlier and those who have received allotment on this basis are being given Free Hold Title on this basis.
