West Bengal has allotting lands, acquired by this Department under the L.D. P and other Act to different schools. colleges, hospitals etc. and clubs library & social organisations etc. The questin of evolving a uniform policy with regard to the terms and conditions under which such allotments can be made and the nature of right and title that may be conferred on them, it has been decided that henceforth the procedure. as prescribed hereunder shall have to be followed uniformly in respect of all such allotments made so far and to be made in future. (i) Schools. Colleges and Hospital are part of amenities necessary for creation of better living conditions in refugee colonies. Ordinarily the Managing Committee or the Board of Trustees of such Institutions may be insisted on paying the land value equivalent to proportionate cost of Acquisitioin and the proportionate cost of development if any, of the area plus interest 4.5% to be calculated from the date of payment of compensation to the date payment of land value. In cases of extreme hardship where the institutions run on charitable basis or are really incapable cf paying the Refugees Rehabilitation Commissioner, West Bengal may approach the Government ot India for writing of this part of expenditure. If. however the Governemnt of India do not agree to such proposals the cost may be treated as pro-rata charge on the beneficiaries Of the colonies (ii) clubs, libraries and social organisation etc. of properly function, may also be considered useful for creation of better living conditions in the colonies/township. But unlike the schools. colleges and hospitals these organisations, may be given short terms lease on terms and conditions to be fixed by Government on the basis of specific recommendation in each separate case. Ordinarily no such allotment should be made to the organisations having partisan or sectarion outlook or faith or practice. The Refugee Rehabilitation Commissioner, West Bengal is requested that the procedure, as prescribed above. are followed in all the cases where he has been allotting lands to the above institution. He is also requested to get a model draft agreement prepared in the Refugee Relief & Rehabilitation Directorate on the above lines keeping in view of Memo. No 3198-Rehab. Dated 9/4/53 and get the drafts vetted by the Government solicitor in this regard. The drafts may also be got approved by the Government in the Refugee Relief & Rehabilitation Department.
