heir(s) of the deceased allottees who have taken over the possessions of the plot and exercised effective possession on it, prior to their date of expiary
  1. Mutation/Transfer may be allowed in favour of the legal heir(s) in effective possession of the relevant plot provided that the legal heir(s) swear(s) an affidavit to the effect that he/she/they is/are the only successor(s) of the deceased allottees in effective possession of the plot and he/she/they has/have no landed property whatsoever anywhere in India. The content of the Affidavit should be verified to ascetain who are the actual heirs. If the declarations in the affidavit are subsequently found to be materially untrue the allotment letter will be liable to be cancelled.
  2. In case the mutation is prayed for in favour of one or more member(s) of the family (of successor/legal heir) of the deceased allottee excluding some other member (s) of the said family, those family members will have to furnish an affidavit declaring that he/she/they has/have no objection to such mutation. In such a case, the particular member (s) of the family in whose name(s) the mutation is applied for shall also swear(s) an affidavit declaring that he/she/they has/have no landed property anywhere in India and he/she/they is/are in effective possession of the plot allotted in favour of the deceased allottee. If the declaration in the affidavit in subsequently found to be materially untrue, the title deed win be liable to be cancelled.
  3. The other terms and conditions of the allotment will be binding on the person(s) in whose favour the land will be mutated.
All necessary steps in this regard will be taken by the office of the Refugee Rehabilitation Commissioner.
