WHEREAS the Donor executed a Deed of Gift in favour of the Donee on___________ for the consideration mentioned therein in respect of the land/plot No.___________of___________ Colony particularly mentioned and described in the Schedule mentioned therein for the rehabilitation of the Donee (s) according to the rehabilitation policy of the Govt. of West Bengal and the said indenture was registered in Book-I. Volume No.___________ Pages___________ to___________ , Being No.__________ for theyear ____________of the Office of the Additional District Registrar District AND WHEREAS during such execution of the said indenture some mistakes and or errors have accidentally crept in the said indenture in contravention of the said rehabilitation policy and thereby tne title and rehabilitation of the Donee has become seriously affected and interrupted in respect of the enjoyment of the said land or plot particularly described in the Schedule of the said indenture and for that the parties herein have mutually agreed to cancel the same.

HOW THIS INDERTURE WITNESSETH that for the consideration as aforesaid the parties here to do mutually cancel the said Deed of Gift with immediate effect (asif the same was never executed or brought into existence) and as such the same was and shall be of no force and effect hereafter and THIS INDENTURE FURTHER WITNESSETH that parties hereto further agree and declare that in consequence of such cancellation as hereunder made all right title interest and claim, demand etc. of the Donee in the property concerned under and by virtue of the purported Deed of Gift which are hereby reconveyed, reassigned and reassured shall be deemed as completely divested, extinguished and discharged and reverted fully to and vested in the Donor as his former estate and they are both placed in the same position in which they were before the said Gift and THIS INDENTURE FURTHER WITNESSETH that the parties hereby mutually agree and covenant to each other that neither of them have done executed and performed any act deed or thing or prejudiced in title or estate or the parties or any of them may be hindered or prevented from cancelling the said Indenture of Gift and realising and re-transferring the said property unto and to the use of the Donor in the manner hereinbefore indicated.
