Whom the lease deed would be executed in case in allotment of land to G .S. F. P. school/Junior / High Secondary/Higher Secondary School. After Careful Consideration of the matter it has been decided that the following principles would be adopted in this regard-
- The allotment of land to recognized education institutions would be made in terms of the guidelines as set out in this Deptt. Memo no. 55-Rehab dated 8.4.98.
- The execution of lease-deed with the educational institution would be as-
- In the case of G. S. F. P. School in the case of allotment of lane to such educational institution, the subject plot would be leased out to the respective District Primary School Council for onward allotment to the concerned Primary School.
- In case of Junior High School/Secondary/Higher Secondary School. In this case the lease deed for land which is proposed to be allotted must be executed in favour of the school itself and not in the favour of its Managing Committee. However, in the lease it may be recited that the School is represented by the Managing Committee comprising of such and members.

The R.R.&R. Deptt, has been allotting homestead plots measuring more or less 60 (sixty) sq. m to the eligible refugee families under the Panchannagram (CMDA) Scheme in East Calcutta area since 1992. Free-hold title deed could not be executed in favour of the allottees till date due to some unavoidable circumstances. It has now come to the notice of the Govt. that some of the allottees have expired and legal heir(s) is /are facing difficulties to exercise the right of possession on the allotted plot for want of valid document in their favour.
After due consideration, the Govt. in R.R.&R. Deptt. Has decided that the following principles should be followed in the matter of transfer of land in favour of legal heir(s) of the deceased allottees who have taken over the possessions of the plot and
