sub: Conferment of right and title on displaced persons over lands
in Govt. sponsored and approved Squatters colonies in West Bengal.

Sir
I am directed to refer to the correspondence resting with your d.o. letter No.453RC(Imp) dated the 6th June, 1973 and to convey the approval of the Government of India to the conferment of right and title on displaced persons over homestead and agricultural lands allotted to them as a rehabilitation measure in Govt. sponsored andSquatters colonies in West Bengal on the following terms and conditions

(i) The land will be transferred free of any cost.

(ii) The land in Government sponsored colonies (518) will be transferred only to those displaced persons who were allotted land under the orders/instructions of the Government in force from time to time. In the case of approved Squatters colonies(149). the eligible allottees will be those who were in occupation of the land as on 31.12.50. In respect of persons who came in possession of the land w.e.f.11.51 the orders contained in this Department's letter No. RSR.21 (1)/63-RE dated 13.4.66 were that they would be given 'Arpanpattras' only after recovering the cost of Land and development. Therefore, the state Government will refund to the Central Government, the amount already realised or to be realised in future from such type of displaced persons. The state Government will also supply a list of such plots in each colony.

iii) The land in the rural colonies will be transferred on free-hold basis subject to the condition that the displaced persons concerned will not be entitled to sell the same for at least a period of 10 years from the date of issue of these orders except under special circumstances. For this purpose a condition will be inserted in the conveyance deeds. The State Government are requested to ensure that there is no scope for speculation or alienation of land in this period and transfer is allowed only in genuine cases of hardship.

The land in the urban area will be transferred on lease-hold basis on the following terms
(a) the lease period will be for 99 years.
(b) the lessee will be required to pay ground rent C Re.1/- per 100 sq. yards ora fraction thereof per annum.
