Government of an amount equal to fifty per cost of the consideration money which amount shall be credited to appropriate receipt head of the Government of India;
(d) that after once the land demised is transferred lessee in terms of thejust preceding clause (c), there shall be no subsequent transfer except with the prior written permission of the Government and on such terms and condition as the Government may deem fit to impose havingregard to the circumstances of each particular case: and
(e) that in every deed of lease to be executed by the Government as lesser on the one hand and the lessee in question on the other the terms referred to in the foregoing clauses (a) to(d) shall be incorporated.

3. The land in rural colonies shall be transferred free of costs to the displacedpersons referred to above on free hold basis on the condition that the transferee shall have no right to alienate the land in any manner whatsoever within a period of ten years from the date of the execution of the deed of transfer without prior written permission of the Government which may be granted only in genuine and exceptional cases of hardship. This condition shall be incorporated in the said deed of transfer.

 

II. Approved Squatters' Colonies

 

1. These displaced persons who were in occupation of different plots of land inapproved squatters' colonies till the31st day of December,1950, shall beeligible for being transferees of these plots. The plots shall be transferred tothe respective occupiers thereof free of cost.

2. These displaced persons who came into occupation of different plots of land in approved squatters' colonies on or after the 1st day of January.1951.shall be eligible for getting these plots transferred to the respective occupants only after payment of pro-rata of the costs of acquisition and development of such plot.

All other general conditions as laid down in para I sub-para 2 (a) to (e) ofthis order in respect of urban colonies shall apply to these approved squatterscolonies also.
III The displaced persons on whom free hold or lease hold right shall be conferred will be exempted from payment of stamp duty required for thedeed of transfer to be executed in their favour.
IV. The Accountant General, West Bengal is being informed.
V. This order issues with the concurrence of Finance Adviser, Refugee Relief & Rehabilitation Department vide his U/O. No. 1104-F.A. dated the 5th Sept.1974.
