Sub : Guidelines for Cancellation/Rectification of Title Deeds.

 

To implement the rehabilitation programme this Department has been issuing Title Deeds to the eligible refugee families in accordance with the provisions laid down in the relevant Govt. Order No. 1240-Rehab. dated 20.04.1987 followed by subsequent modfications,
2. It has now been observed that during execution of these deeds mistakes have been effected in some of the Title Deeds due to either inadvertence or misrepresentation by the Donees at the time of declaration on Sworn-in-Affidavit. To correct these mistakes the following procedure should be adopted.
3. Where only minor rectification of the deed is required to be done the procedure has been indicated in the model proforma enclosed at Annexe-I.
4. Where a deed is required to be cancelled. the following procedure should be followed.
  1. Where the Donee is agreeable to become a party for the proposed cancellation, a deed of cancellation may be executed and registered by mutual arrangement.(Proforma enclosed at Annexe-II).
  2. Where the Donee is reluctant to cancel the Title Deed, a notice should go to him/her informing him/her that the said deed is liable to be cancelled for the reasons to be stated through the process of law. After expiry of the notice period (that is one month) a Title Suit mav be filed by the Collector of a District and in other cases Secretary of the Department on behalf of the State of West Bengal.
5. If it comes to the notice of concerned office that a false affidavit has been submitted. the Deed issuing authority may file a complaint for the offence punishable U/S 199 of I.P.C. against the dependent concerned, in appropriate criminal Court.
6. In view of the aforesaid guidelines, the concerned authorities are directed to sort out the cases for Rectification /Cancellation after proper enquiry of Title Deeds which were wrongly issued.
