I am directed to refer to letter No. 26 (6)/83-RR (Vol.1)dated 27th February.1987 from the Government of India. Ministry HomeAffairs (Rehabilitation Division)on regularisation of squatters'colonies set up by displaced persons from former East Pakistan (now Bangladesh) in West Bengal during the period from 1st Jauary. 1951 to 25th March.1971. A copy of this letter is enclosed(ANNEX I).
2. In the above letter the approval of the Government of India was accorded to the regularisation of 607 Post-1950 squatters' colonies, the lists of which had been furnished by the State Government. Earlier the Government of India had approved regularisation of 149 Pre-1951 squatters' colonies and 175 Post-1950 squatters' colonies.The regularisation of all such approved squatters' colonies by way of acquisition and inter-departmental transfer of land and subsequent conferment of right and title is in progress. Since the Government of India's approval to the regularisation of 607 squatters.colonies has now been received, the State Government in the R. R. & R. Department is now required to undertake the regularisation of all these squatters' colonies so as to achieve rehabilitation of the displaced persons settled therein. The Refugee Rehabilitation Commissioner, West Bengal and the Collectors of the districts are authorised to take up the matter with utmost priority and proceed on the line detailed below. A list of squatters' colonies of each district approved for regularisation by the Government of India under letter No. quoted above is furnished for this purpose (ANNEX II).
(i) While the ongoing scheme for regularisation of the d.p. squatters' colonies approved earlier will continue without interruption. a time-bound programme may be framed simultaneously for implementation of the regularisation scheme in respect of the fresh list of squatters' colonies.
(ii) Land Acquisition proposals in respect of the private lands to be acquired may be initiated as early as possible. Detailed paticular in respect of quantum of land to be acquired and estimated land acquisition cost at average current market price nave been incorporated in the statement at Annexure III. A strict time schedule for land acquisition has to be framed and maintained so as to complete the acquisition proceedings in a period of three years. It may be noted that escalation in land costs due to delay in acquisition of land beyond three years will not be borne by the Government of India. So in the interest of speedy land acquisition the district authorities are advised to take recourse to the provisions of the West Bengal Land (Requisition and Acquisition) Act, 1948. i. e. West Bengal Act II of 1948. for this purpose in respect of acquisition covered under Government of India order dated 27.2.87(ANNEX I). The on-going acquisition schemes under L D P Act '48 may, however, continue to be in forece respect of continuing schemes
