Sub : Guidelines in connection with acquisition of land for regulansation
of Post-50 D.P. Squatters' Colonies approved by Government
of India. under the provisions of the West Bengal Land
(Requisition and Acquisition) Act. 1984 i.e. West Bengal
Act II of 1984.

 

The Government in the Refugee Relief & Rehabilitation Department have already decided to acquire the lands of the Government of India-approved Post-50 Squatters' Colonies under the provisions of the West Bengal Land (Requisition and Acquisition)Act.1948 i. e. the West Bengal Act II of 1948. A model format for submission of proposal to local Land Acquisition Officer for initiating acquis!tion proceedings under the provisions of said Act is attached hereto.
In order to facilitate him to discharge his functions effectively in the matter of submission of proposal for land acquisition proceedings he may be requested to follow the undermentioned guidelines.
Lands in actual occupation of the refugee families in each colony alongwith small vacant plots within the colony should be surveyed in the field. Thereafter a Site Plan has to be prepared for each colony on the basis of a revisional settlement map which will be available in the Collector's Record Room of each District. Small vacant plots within the colony will haVe to be shown in the Site Plan. After preparation of the Site Plan a plot schedule showing area of each C. S. Plot and R. S. Khatian No. in which the C. S. Plot is included has to be prepared with reference to Revisional Settlement records. The R.S. records are available with the local 'II Camp Office of the Settlement Department. At the time of verification with settlement records the name of the owner and address may be noted. The C.S. Plot No. and the area as recorded in the R.S. record has to be accepted as correct. In the case of part plot, specific portion of the same with indication of boundary should be noted in the plot schedule. [At this stage no layout plan or survey map for conferment of right and title need be prepared. That will have to be prepared before distribution of land to the eligible regugee families through title deeds). Next. the Site Plan. so prepared must have to be got approved byCollector/ Additional Collector/Sub-divisional Officer who has already been authorised to do so vide this Department G. 0. No. 1534-Rehab. dated 16.5.87. One copy of such approved Site Plan in tracing cloth and three printed copies (total four) with the plot schedule in\duplicate may be submitted to the Land Acquisition Collector with a forwarding Memo (vide format annexed) requesting him to take necessary action for requisition and acquisition of the land under the provision of the West Bengal Act II of 1948 and deliver possession of the land to the local R. R. Office immediately after completion of formalities as required under Section 3 and 8B of the said Act.
In this connection it may be made clear that land acquistion proceedings alreadystarted under the provisions of West Bengal L.D.P. Act.1948 shall have to be completedunder the same Act(i e. West Bengal L.D.P. Act. 1948) and they must not under any circumstances be switched over to the West Bengal Act II of 1948.
