to the fact that in a large number of cases there has been violation of the patta conditions in the shape of transfer/desertion by and exchange of possession amongst the Patta holders etc.

After careful consideration the Governor has been pleased to decide that in such cases the related patta should be annuled. On such annulment the patta-lands will stand resumed to Government. The R. R. & R. Department will, thereafter, issue freehold lease according to their scheme in respect of such lands to eligible persons after conducting such detailed survey and verification. as may be necessary.

Calcutta, the 17th January.1989

 

Sub : Conferment of free-hold right and title in respect of lands settled
under the provisions of the West Bengal Land Reforms Act. 1955.

 

The undersigned is directed to say that the State Government in the Refugee Relief & Rehabilitation Deptt. have decided, with the approval of the Government of India, that free-hold right and title would be conferred on the displaced persons who have settled in Govt. sponsored and approved squattars' colonies in respect of the lands under !heir possession. A large number of such colonies have sprung up on khas and vested lands. Lands in such colonies under the possession of the displaced persons have in many cases been settled with them under Sec. 49 (1) of the W. B. L. R. Act, 1955 with delivery of Pattas. The R. R. & R. Deptt. now proposes to confer free-hold right and title to the eligible displaced persons in respect of the lands for which they had already been granted pattas under the aforesaid Act.

2. Questions have been raised if the displaced persons holding such pattas should be requirud to surrender heir lease-hold rights and if lands comprised in these pattas are required to be transferred in favour of R. R. & R. Deptt. by the Land & Land Reforms Deptt. before they are considered for grant of free-hold title deeds. The matter was referred to the Law Officers of the Government who have advised that absolute title may be transferred to these patta-holders without their formally surrendering the Lease-hold rights granted by pattes. They have further advised that the State Government being the owner of the lands in question it is not necessary to transfer the lands
