ANNEX TO LETTER No : 21/1/65-RE

 

Dated the 13th April, 1966

 

General Instructions in regard to the exercise of powers delegated to the State Govt. to sanction funds for acquisition of land and development of colonies and rehabilitation loans to squatters.

 

 

I. Acquisition of land:-
1. Acquisition for regularisation of squatters colonies or for providing alternative land to squatter will be made under the West Bengal Land Development and Planning Act,1948.

2. Acquisition for providing land to rehabilitable families from permanent Liability Homes may be made under Land Acquisition Act.1894.

3. Acquisition for various categories of displaced persons should be regulated on the basis of the area (including of area for common amenities) and cost per family specified in the statement enclosed as appendix I to these instructions
Provided that—
(i) In the case of rehabilitable families from Permanent Liability Homes, increase in cost per family in an urban area may be allowed upto to the following limit
Urban Rs.1,600
Rural (Homestead Rs. 200
land for non-agriculturists)
(ii) The area of the homestead plot in an urban area in any colony for rehabilitable families from Permanent Liability Homes where allotments are made after the 13th May. 1966 may be restricted to 150 sq. yds.
Note : (i)This ceiling has been raised from Rs. 1,600 with the provision that individual will be scrutinised carefully by the State Government.
(ii) Urban area in defined as "a colony situated within the limits of an existing Corporation or a Municipality or close to the limits of such a body."

4. In the case of acquisition of land for regularisation of squatters' colonies, It will to ascertained that the matorrty of the squatters are those who have occupied the land before 1. 1. 1951. The colonies where the majority of squatters are those who have occupied the iand after 1 1.51 will not be regularised. The prorata cost of acquisition will be recovered in cash from the displaced persons who have squattered after 31.12.1950 before the Arpanpatras are given to those squatters.

5. Departmental charges shall be allowed at the rate prescribed in this Ministry's letter No.23(9) RH(U), dated 18/19th February, 1957 (copy enclosed as Appendix II to these instructions).
