(2) Deed forms coded as "Urban-vested-gift"—such forms will be issued where no lease-hold right in respect of State Govt's khas/vested departmental lands has been conferred and fresh free-hold right and title will have to be granted.

(3) Deed forms coded as "Urban-acquired-lease--gift" such forms will be issued where 99 years' lease-hold right in respect of acquired lands has been conferred and will have to be converted into free-hold right and title.

(4) Deed forms coded as "Urban-acquired-gift"—such forms will be issued in respect of acquired lands where no lease-hold right has been conferred and fresh free-hold right and title will have to be granted.

(ii) In terms of the existing Govt. policy free-hold right and title deed may be exulited only in favour of displaced persons from erstwhile East Paskistan (now Bangladesh) who is in effective possession of an urban plot or a part thereof with a structure on a portion of it as his own as allottee/arpan patra holder regularised squatters on lands belonging to the State Govt. in the R. R. & R. Deptt. acquired or received through transfer through the process of law provided that the said plot is free from legal proceedings/law suits, or of disputes serious in nature.
(iii) If an allottee/arpan patra holder/regularised squatter for reasons of age.infirmity and the like desires in writing to have the deed executed in favour of otherm eligible persons in effective possession of the plot in question the title deed may be soexecuted.
(iv) In case where the allottee/arpan patra holder/regularised squatter is found dead. free-hold right and deed should be executed in favour of the person/persons execising effective possession provided that such persons belong to the members of deceased allottee and swear an affidavit before hand declaring inter alia that they are the only persons in effective possession or along-with some other eligible persons to be named. If the declarations in the affidavit in such cases are subsequently found to be materially untrue, the title deed will be liable to the cancelled.
.(v) Where lease-deed has been executed and lease-holder/ holders have since expired, the surviving members of the family, on record. may produce succession certificate atternatively swear affidavit to the effect that they are the heirs of the deceesed lease-holders and are maintaining possession of the lessed property. The eligibility of such cases should be determined on verification of the contents of the affidavits as far as possible and necessary action in regard to delivery of free-hold deeds be taken-accordingly. In such cases the surviving members in effective possession may be given free-hold deeds jointly or separately and, if necessery by-numbering of plots may be allowed provided there is an amicable settlement among the claimants.
(vi) Where leasedeeds already granted have been mortgaged with financial institutions or Govt. offices against loan, such lease-deeds may be converted into free-hold deeds provided the deeds are released by financial institution. Govt. offices for the purpose of conversion and the lease-holders give an undertaking to the effect that free-hold deeds after conversion will again be mortgaged with the concerned offices or as per terms and conditions which may be laid down by these offices.
