Sub :Guidelines for implementation of the scheme of conferment of right
and title to refugee settlers in urban areas of West Bengal.

The Government of West Bengal in the Refugee Relief & Rehabilitation Department Issued Government order bearing memo. No. 3959-Rehab. dated 10th Nov.. 1986 declaring the decision to give free-hold and permanent title deeds to the occupants of the d.p. colonies situated in urban/ municipal areas on the State Government's ow vested. khas or departmental lands. Subsequently another Government order under memo. No. 347-Rehab. dt. the 29th January. 1987 was issued by the Department conveying the Government decision to confer similar free-hold right and title to the displaced persons in urban/municipal areas in occupation of other lands such as lands belonging to the Government of India. Deptts. or Govt. of India Agencies and lands acquired by the State Govt. under statutory processes. As R. R. Directorate as well as the district R. R. offices will now be required to implement the State Government's decisions incorporated in those Govt. orders it is felt necessary that revised instructions and guidelines be issued to them for undertaking the work in a smooth and systematic manner.
2. In the circumstances mentioned above the undersigned is directed to say that the Governor is pleased to direct that the right and title to the plots of urban G.S and squatters colonies may be conferred on displaced settler' as per prescribed free-hold right and title deeds in accordance with the following principles
(i) For the purpose of conferment of right and title the refugee colonies in West Bengal may be catogonsed as follows :
(a) Govt. Sponsored Colonies(L.A. proceedings are complete).
(b) Pre-1951 Squatters' Colonies(L. A. proceedings are complete).
(c) Approved post-1950 Squatters' Colonies(L. A. proceedings are in progress).
(d) Pre-1971 Squatters' Colonies(land acquisition/land transfer to be initiated).
(e) Post-1971 Squattees' Colonies set up on khas/vested lands.
In urban/municipal areas, the systems of giving 99-years' lease deeds on acquired lands and of 999 years' lease deeds on khas/vested ands have been in force so long. In terms of the latest Govt. orders the lessees of both categories are now entitled to have free-hold title to their homestead plots on surrendering their registered lease / deeds to Government. The refugee settlers in Govt. sponsored. pre-1951 squatter's colonies and post-1950 colonies set up on vested!khas lands can be given free-hold title to their homestead plots nght now whereas the refugee settlers post-1950 Squatters'Colonies on private lands will have to wait till their lands are acquired by Government.
For the purpose of grant of free-hold right and title in different urban colonies. four different types of deeds are now prescribed, as detailed hereunder
(1) Deed forms coded as "Urban—vested—lease—gift" -such forms will be issued where 999 years' lease-hold right in respect of the State Govt's
