Extracts from the order of the Secretary, R.R. & R. Deptt., at N.S.P. 37 at File No.R. Ft/0/10M-421/97


The State Govt. in the R.R. & R. Department has decided that the refugee families squatting in colonies, under 998 group, situated wholly on lands belonging to the State Govt. may be granted free-hold title deeds on fulfilment of the same eligibility criteria and under the same terms and condition as is granted to them in the recognised colonies (vide R.R. Department memo no. 3474-Rehab./S-715(RR)/95(dt.29.12.99). Apreliminary survey in respect of 998 gr. of colonies has been taken up and 217 number of colonies in different districts, have been found to be located wholly in Govt. land as per latest available report. In order to giving the effect of the said order by granting free-hold title deeds to the eligible refugee families in terms of the provisions of the afroresaid G. 0., the subject land is required to be transferred in favour of the R.R.& R. Department. To effect the formal transfer of such land, the procedural formalities as embodied in executive instruction contained in Chapter XV of the L.A. Manual, 1951 read with land transfer rules have to be generally followed. In this context, L. & L. R. Deptt. memo no. 2994 dated 9.7.1996 may be referred to (copy enclosed).As the procudures involve time consuming factors. we may take the recourses as stated in L. & L. R. Deptt. G. 0. No. 4961 (18) -L.A. dt.22.12.8 / and memoNo. 2974(54) -L.A. dt. 18.1.88 for transfer of Khas/Vested land, pending completion offormalities of transfer of land. As regards the transfer of land owned by the different Deptt. of the State Govt., we may follow the Govt. order 4032-Rehab d1.19.9.89(copy enclosed) as stipulated the Para-5 of the G.O. No.3474 dt. 19.12.95.

In a nutshell, the R.R. Directorate will send a proposal for transfer of land supported by a site plan and the land schedule with indication whether the land is Khas/vested or owned by other State Govt. Deptt. to this Deptt. The site plan should be drawn up in tracing cloth and submitted to this Deptt. alongwith 3 copies of ammonia print so as to enable the Deptt. to move the concerned Deptt. of the State Govt. for transfer of the land. On receipt of the No objection from the concerned Deptt. seeking to transfer the land in favour of the R.R.& R. Deptt. for regularisation of the colonies, the L. & L. R. Deptt. will be moved for settlement of such land in favour of R. R. & R. Deptt. On relinguishment of same in favour of L. & L. R. Deptt. by the transfer or Department for subsequent allotment to R. R. & R Deptt.
