The undersigned is directed to state that the State Government has been considering for some time past a proposal for conferment of free-hold right and title to homestead land to the displaced persons living in Squatters' Colonies which have not yet been recognised by the Government of India. but which are situated wholly on lands belonging to the State Government. After careful consideration in the matter, the undersigned isdirected to say that the Governor is pleased to decide as follows:
1. The unrecognised colonies included in the list enclosed at annexure-B submittedby the refugee organisations will be surveyed and proposals for transfer of land (to the R. R. & R. Department) will be sent for these colonies where the Squatters are refugees squatting over an area of land which is wholly owned by the State Government.
2. Refugees squatting in colonies situated wholly on lands belonging to the state Government may be granted free-hold title deeds on fulfilment of the same eligibility criteria, and under the same terms and conditions as is granted to them in the recognised colonies.
3. The Refugee Relief and Rehabilitation Department will take up the work of distributing free-hold title deeds in respect of these colonies which are found to be situated wholly and exclusively on Khas/Vested/State Government lands. On the basis of prima facie evidence if a colony is found to spring up on both Khas/Vested/State Government lands and Central or Rayoti land. regularisation of that colony will not be taken up till such time as the clearance from either the Central Government or other authorities concerned are obtained.
4. In keeping with the procedure followed for the recognised colonies,in the case of colonies situated on Khas/Vested lands, the Refugee Relief and Rehabilitation Department will make survey of the lands and place a requisition for transfer of the lands with the L. & L.R. Department. After the land is transferred by the L. & L. R. Department the Refugee Relief & Rehabilitation Department will grant free-hold title deeds to the displaced persons.
5. In keeping with the provisions followed for recognised colonies, in the case of colonies situated on lands belonging to other departments, the Refugee Relief & Rehabilitation Department will make a suvey of the lands and place a requisition for transfer with the department which owns the land. The provisions of G.O. No. 4032-Rehab. dated 19-9-89. will be applicable in these cases also. In case the department which owns the land does not respond within a period of two months- the land will be deemed to be transferred free of cost to the Refugee Relief & Rehabilitation Department which will then go ahead with the issue of title deeds.
